Terms of Service

1. Acceptance of Terms
Welcome to CardChase.net ("CardChase," "we," "us," or "our"). By accessing or using our website, mobile applications, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
These Terms constitute a legally binding agreement between you and CardChase. Please read them carefully before creating an account or making any purchase.
2. Account Terms
2.1 Eligibility
You must be at least 18 years of age to create an account and use the Service. By registering, you represent and warrant that you meet this age requirement and that all information you provide is accurate and complete.
2.2 Account Security
You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@cardchase.net if you suspect any unauthorized access or use of your account.
2.3 Account Termination
We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service ceases immediately. Any cards held in your Vault at the time of termination will be handled in accordance with Section 5 below.
3. Pack Purchases
3.1 Nature of Packs
CardChase slab packs contain real, professionally graded trading card slabs (authenticated by PSA, CGC, BGS, or SGC). Each pack contains a randomized selection of cards determined by our provably fair system.
3.2 Provably Fair RNG
All pack outcomes are determined using HMAC-SHA256 cryptographic random number generation with a pre-committed server seed. You may verify the fairness of every pull after the fact. Full technical details are available on our How It Works page.
3.3 Pricing and Payment
All prices are listed in Canadian Dollars (CAD) unless otherwise stated. Payments are processed securely through Stripe. You agree to provide valid payment information and authorize us to charge the applicable amount at the time of purchase.
3.4 No Refunds on Opened Packs
Once a pack has been opened and the cards revealed, the transaction is final and non-refundable. This is because pack contents are determined and revealed irreversibly at the time of opening. Unopened packs may be eligible for a refund within 48 hours of purchase at our discretion.
4. Marketplace
4.1 Commission
CardChase charges an 8% commission on all marketplace sales. This fee is deducted from the seller's proceeds at the time of sale. There are no listing fees.
4.2 Seller Responsibilities
Sellers may only list cards that are currently held in their CardChase Vault. By listing a card, you authorize CardChase to facilitate the transfer of ownership to the buyer upon successful payment. All listings must accurately represent the card being sold.
4.3 Buyer Responsibilities
Buyers are responsible for reviewing listing details before completing a purchase. All marketplace sales are final. Purchased cards are transferred to the buyer's Vault immediately upon payment confirmation.
4.4 Dispute Resolution
If a dispute arises between a buyer and seller, CardChase will act as an intermediary and make a final determination at its sole discretion. We reserve the right to reverse transactions, issue refunds, or take other action as we deem appropriate.
5. Vault Services
5.1 Storage
Cards acquired through pack openings or marketplace purchases are stored in our secure, climate-controlled vault facility. CardChase provides vault storage at no additional charge for as long as your account remains in good standing.
5.2 Insurance
All cards stored in the CardChase Vault are fully insured against theft, damage, and natural disasters. In the event of a covered loss, CardChase will compensate you based on the fair market value of the card at the time of loss, as determined by recent comparable sales data.
5.3 Shipping Requests
You may request physical delivery of any card in your Vault at any time. A flat shipping fee applies per shipment, as displayed at the time of your request. Shipping is available to addresses within Canada and the United States. International shipping may be available at additional cost.
5.4 Account Termination and Vault Holdings
If your account is terminated, you will have 30 days to request shipment of any cards in your Vault (shipping fees apply). After 30 days, unclaimed cards may be liquidated, with net proceeds (less applicable fees) returned to you via your payment method on file.
6. Prohibited Conduct
You agree not to engage in any of the following activities:
- Using the Service for any illegal purpose or in violation of any applicable law or regulation.
- Creating multiple accounts to exploit promotions, bonuses, or referral programs.
- Attempting to reverse-engineer, decompile, or tamper with the provably fair system or any other aspect of the Service.
- Engaging in market manipulation, including wash trading or artificially inflating card prices on the marketplace.
- Using automated scripts, bots, or other tools to interact with the Service without our prior written consent.
- Harassing, threatening, or abusing other users of the Service.
- Circumventing or attempting to circumvent any security measures or access controls.
- Impersonating any person or entity, or falsely representing your affiliation with any person or entity.
7. Intellectual Property
All content, trademarks, logos, and intellectual property displayed on the Service are the property of CardChase or its licensors. You may not reproduce, distribute, modify, or create derivative works from any content on the Service without our prior written consent. Trading card images and grading company logos are the property of their respective owners and are used for identification purposes only.
8. Limitation of Liability
To the maximum extent permitted by applicable law, CardChase and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to:
- Loss of profits, revenue, data, or other intangible losses.
- The value or perceived value of cards received from pack openings.
- Unauthorized access to or alteration of your account or data.
- Any interruption or cessation of the Service.
Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to CardChase in the twelve (12) months preceding the event giving rise to the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless CardChase and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario, Canada. You irrevocably consent to the jurisdiction and venue of such courts.
11. Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and notify you via email or through a prominent notice on the Service. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
